Constitution Day Essay: Constitution day in India is celebrated on 26 November as a symbol when India adopted its constitution. However it is important to note that constitution was enforced on 26 January and thus we celebrate it as a republic day. Constitution is not merely a book or some pages of principle but instead these are the very basic idea on which our India in build upon.
People often get confused between difference in constitution and law. It is important to note that constitution is law of laws. No law, rules and regulation in the country can be enforced or build which are against the very spirit of constitution. Our constitution provides us liberty, freedom and fraternity by very birth. It is a symbol of our freedom struggle as many principle of our freedom fighter either be Mahatma Gandhi or Subash Chandra Bose are enshrined in it. For an example articles related to Panchayat Raj and cottage industry gives a space to the ideas of Mahatma Gandhi and whole concept of directive principles of state polity gives space to the idea’s of Subash Chandra Bose.
While the chief architecture of our constitution was B.R. Ambedkar who was also the chairman of drafting committee he make sure that the constitution give equal opportunity to everyone. Hereby in the constitution itself any kind of discrimination on the basis of caste, sex, place of birth etc is strictly prohibited.
One unique feature of our constitution is its fine balance between flexibility and rigidness. Let us understand it with example, our forefather make sure that the constitution must be flexible enough so as to encapsulate the need of time. If a constitution build rigid it will be against the principle of evolution. Hence we see many time governments brings amendment to the constitution so as to address to the very changing need of society but at the same time our constitution is rigid when it comes to protect basic liberties, right, freedom of the citizens. In very famous case of Keshvanand Bharti vs. government of India, Supreme Court clearly stated that government cannot change the very basic structure of the constitution today those pillars are known as basic structure doctrine.
One of the most important role of constitution is to keep government is check. To make sure who so ever comes in power works according to the principles of constitution. Now you might me wondering how a book can make sure government remains in its sphere or what will happen if someone will work against the spirit of constitution. Who is going to punish them?
Answer is Supreme Court and High court. Supreme Court is the chief custodian of the constitution of India and hence if anything goes against the spirit of constitution it is the duty of Supreme Court and look into the matter for doing so constitution itself had provided unprecedented freedom and powers to judiciary so to make sure they are dependent on government for anything and working fearless.
The idea of equality in our constitution is very unique as it not only means giving everyone an equal chance in addition it relies on providing equal playing field. Those communities who have been subjugated to in human treatment for centuries and somewhere left behind needed an extra push or care only then we can provide them an equal level playing field. This thing had been taken care on in our constitution in the name of reservation.
Not only that constitution had made specific obligations to the government to make sure that extra care of women and child should be taken care and if required some extra efforts needed to be done to make their holistic development take place.
Our constitution is often criticized as unitary bias towards centre meaning is it provides some extra power to the central government with respect to the state government though this is true but one should be aware of why this was done us. If you recall the conditions in which our constitution was drafted British had taken advantage of our disputes of kings and state and slowly and slowly gained control all over the India. Thus to prevent anything that is going to make it happen again it is important to keep state governments on check and this can only be done by making sure that central government do have some extra power like powers to implement governor rule, president rule, emergency etc.
Furthermore many strong constitutional institution were created to make sure that the government discretion should be remain in check like
Election commission of India is mention in constitution itself making it completely independent body and conduction free and fair election across the country.
Compiler and Auditor general of India is a complete independent body making sure each and every account of government goes in complete scrutiny.
Union and public service commission famously known as UPSC ensure that government exams are conducted with complete fairness and no advantage to be given to someone.
With Supreme Court combine these four institutions are known as Bulwark of the constitution of India.
Though in 76 years of independence India had gone through many ups and downs either be wars or emergency or financial crises but we as a nation always had bounced back on our feet with more strength and it is only because of constitution as our foundation of the state is strong these small storms have no power to shake them up.
However as citizens we do have a duty too. That is make sure that we choose right people to run government help government agencies whenever require, pay our taxes and follow all the rules and regulation.
