Necessity of uniform civil code Essay : Uniform civil code (UCC) defines the formation of one law for India citizens, be it caste, creed or religion. People from various religions are treated equally under one uniform law for all. Just like the law for criminal justice or punishment is equal to all persons of different religions, caste, depending on the depth of sentence.
History of Uniform Civil Code
The Uniform Civil code goes back in time, when British Government wherein they submitted report in 1835, stressing the need for uniform code if the Indian Law, pertaining to crimes and contracts. Excluding the personal laws of Hindus and Muslims were kept outside the code. For example laws relating to marriage, divorce, adoption, are directed by the practices of the communities personally. Every religious community have their own laws as applicable.
Challenges faced in implementing Uniform Civil code
- The task of implementing a code that will give equal rights and equal justice to all citizens considering the differences in the interest of the people can be a tedious task.
- The Uniform Civil code has not been defined or given proper awareness to the people specially in remote villages. This can mislead the public specially from minority groups to believe that the code is against their interest or rights.
- Different religious communities have different personal laws which lead to political interest and conflict of interest in the Uniform civil code.
- Lack of political will due tocomplexity And sensitivity of the issue.
Way forward in implementing UCC
- A broadminded view should be given towards UCC and people should be encouraged through its awareness specially to the minority groups of the society. As they should not feel unwanted or left out from this code.
- The UCC should be drafted in a way that will not bring any conflict of interest to any religious groups or minority groups in the society. The sentiments of these groups should also be taken care of.
- Suggestions should be taken from various religious groups to implement the code effectively, so that it won’t hurt anyone’s sentiments be it religion, cast or creed. The UCC must not affect the personal laws of the religious groups.
